These Terms apply to all visitors, users, and subscribers of our services, including home service businesses ("Clients") and their customers or leads ("End Users") who interact with our automated systems.
Axym provides digital growth services for home service businesses. Our services include:
Our AI voice agents handle lead qualification and appointment booking. They do not provide professional trade advice or dispatch emergency services.
Our services are intended for use by home service businesses operating in the United States. By subscribing, you represent that you are authorized to enter into this agreement on behalf of your business and that your business holds all required licenses and certifications for your trade.
Account creation: To use our services, you must provide accurate and complete information during onboarding. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Subscription billing: Services are billed on a monthly subscription basis at the rate agreed upon during signup. Payments are processed automatically each billing cycle. All fees are in U.S. dollars.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months. Upon cancellation, your services will be deactivated at the end of the billing period.
Setup fees: One-time setup fees are charged at the time of onboarding. Setup fees are waived when subscribing to two or more services simultaneously. Setup fees are non-refundable once work has commenced.
As a Client, you agree to:
Transactional messages: Axym sends SMS messages for transactional purposes including lead response confirmations, appointment follow-ups, review requests, and service-related communications.
End User consent: SMS messages are sent only to individuals who have initiated contact with your business by calling your phone line or submitting a web form inquiry. By initiating contact, End Users consent to receiving transactional SMS communications related to their inquiry.
Opt-out: End Users may opt out of SMS messages at any time by replying STOP to any message. Reply HELP for assistance. Once opted out, no further messages will be sent unless the End User initiates new contact.
Message frequency: Frequency varies based on lead and appointment activity.
Message and data rates: Standard message and data rates may apply depending on the End User's mobile carrier and plan.
No data sharing: Axym does not sell, rent, or share SMS opt-in data, consent records, or phone numbers with third parties for marketing or advertising purposes.
Carrier liability disclaimer: Axym and mobile carriers are not liable for delayed or undelivered messages.
Age restriction: SMS messaging services are intended for users aged 18 and older.
All content, materials, software, AI models, workflows, and intellectual property provided by Axym are the property of Axym LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use our services solely for operating your business's communication and marketing needs during the term of your subscription.
You may not copy, modify, distribute, sell, or create derivative works based on our technology, content, or materials without prior written consent.
Website content, copy, and designs created specifically for your business during onboarding remain your property upon termination of service.
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our services, you consent to the practices described in the Privacy Policy.
Axym provides its services "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or completely secure, that our AI voice agents will handle every call scenario perfectly, or that any specific business results will be achieved from using our services.
To the maximum extent permitted by law, Axym LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to lost revenue, missed leads, missed jobs, data loss, or business interruption.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid to Axym in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Axym LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.
Axym reserves the right to modify these Terms of Service at any time. We will notify Clients of material changes via email or by posting updated terms on our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in Louisiana.
Axym may suspend or terminate your access to our services at any time for violation of these Terms, non-payment, or any conduct that we determine to be harmful to our services or other users. Upon termination, your right to use our services ceases immediately.
