By accessing or using the website at axym.co or any services provided by Axym LLC ("Axym," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
These Terms apply to all visitors, users, and subscribers of our services, including medical practices ("Clients") and their patients or callers ("End Users") who interact with our AI voice agents.
Axym provides AI-powered voice agent services for private medical practices. Our services include:
Our AI voice agents handle appointment logistics and call routing. They do not provide medical advice, diagnoses, or treatment recommendations.
Our services are intended for use by licensed medical practices and healthcare providers operating in the United States. By subscribing, you represent that you are authorized to enter into this agreement on behalf of your practice and that your practice holds all required licenses and certifications.
Account creation: To use our services, you must provide accurate and complete information during onboarding. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Subscription billing: Services are billed on a monthly subscription basis at the rate agreed upon during signup. Payments are processed automatically each billing cycle. All fees are in U.S. dollars.
Free trial: New clients may be eligible for a 14-day free trial. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid plan.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months. Upon cancellation, your AI voice agent will be deactivated and call forwarding should be redirected back to your practice.

By using our services, you acknowledge and agree to the following SMS messaging terms.
Transactional messages only: Axym sends SMS messages exclusively for transactional purposes, including appointment confirmations, appointment reminders, rescheduling links, and post-call follow-up summaries. We do not send promotional or marketing messages.
End User consent: SMS messages are sent only to individuals who have initiated contact with a medical practice by calling the practice's phone line or submitting a web form inquiry. By initiating contact, End Users consent to receiving transactional SMS communications related to their inquiry or appointment.
Opt-out: End Users may opt out of SMS messages at any time by replying STOP to any message. Reply HELP for assistance. Once opted out, no further messages will be sent unless the End User initiates new contact.
Message frequency: Frequency varies based on appointment activity. Typical End Users receive 1–3 messages per appointment interaction.
Message and data rates: Standard message and data rates may apply depending on the End User's mobile carrier and plan.
No PHI: SMS messages do not contain protected health information. Messages are limited to appointment logistics such as date, time, provider name, and scheduling links.
No data sharing: Axym does not sell, rent, or share SMS opt-in data, consent records, or phone numbers with third parties for marketing or advertising purposes.
Carrier liability disclaimer: Axym and mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and device compatibility.
Age restriction: SMS messaging services are intended for users aged 18 and older. By opting in to receive messages, you confirm that you are at least 18 years of age.
All content, materials, software, AI models, workflows, and intellectual property provided by Axym are the property of Axym LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use our services solely for operating your medical practice's communication needs during the term of your subscription.
You may not copy, modify, distribute, sell, or create derivative works based on our technology, content, or materials without prior written consent.
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our services, you consent to the practices described in the Privacy Policy.
Where applicable, Axym will enter into a Business Associate Agreement (BAA) with Clients to ensure compliance with HIPAA requirements.
Axym provides its services "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
Our AI voice agents are not a substitute for professional medical judgment. In the event of a medical emergency, our agents direct callers to call 911.
To the maximum extent permitted by law, Axym LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to lost revenue, lost patients, missed appointments, data loss, or business interruption.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid to Axym in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Axym LLC, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.
Axym reserves the right to modify these Terms of Service at any time. We will notify Clients of material changes via email or by posting updated terms on our website. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in Louisiana.
Axym may suspend or terminate your access to our services at any time for violation of these Terms, non-payment, or any conduct that we determine to be harmful to our services or other users. Upon termination, your right to use our services ceases immediately.
